We, Near Rezidence s.r.o., with its registered office at Václavské náměstí 2132/47, Nové Město, 110 00 Prague 1, ID No. 232 16 484, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File 423390 (the “Company”), as a personal data controller, hereby inform you, i.e. users and those interested in our services who have decided to use our real estate services of our Company, visitors to this website, business partners and, if applicable, their representatives or other contact persons (collectively referred to as “you”), about the following:

  • what personal data about you we process;
  • for what purposes and for how long we process your personal data;
  • to whom and why we transfer your personal data;
  • where we obtained your personal data from; and
  • what rights you have in relation to the processing of your personal data.

We have issued and published this policy in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, the General Data Protection Regulation (“GDPR”) in order to comply with our information obligation as a controller of your personal data under Articles 13 and 14 of the GDPR. 1 What categories of your personal data do we process?

In order to be able to properly provide you with our complete real estate services and related services, we process the following categories of personal data about you, but we always process only those personal data that are necessary for a specific purpose:

1.1 Basic personal identification data

This category includes, in particular, data that is necessary for the conclusion and performance of a contract between us and you.

  • academic degree
  • name and surname
  • date and place of birth
  • personal identification number
  • permanent residence address and/or correspondence address
  • company ID, VAT number
  • function of a natural person acting on behalf of a legal entity
  • address of the registered office or place of business
  • billing address
  • type and number of the identification documents provided – only for the purpose of concluding a contract
  • personal data of your representative or contact person designated by you
  • signature
  • login and password – only for communication through the Realpad portal

1.2 Contact details

This category includes data that we use to communicate with you about our services.

  • contact phone number
  • contact e-mail address

1.3 Service, financial and transaction data

This category includes data related to your use of our real estate services and related services.

  • type and specification of the service provided
  • data on the use of the service provided

1.4 Data stored in connection with the operation of the website

This category includes data that is processed in connection with the use of our website:

  • site activity data (cookies)
  • IP address and other technical data about the device from which the site is viewed
  • data obtained from analytics tools (e.g. Google Ads or Google Analytics)

1.5 Other data appearing in connection with our activities

In connection with the provision of our services, we may randomly receive and process other types of personal data from you, which are related to the specifics of the service provided, but cannot be defined in advance. In these specific cases, we will inform you individually to the extent stipulated in Articles 13 and 14 of the GDPR.

2 For what purposes and on what legal basis do we process your personal data

For each processing of your personal data, we have a valid legal basis (title) compliant with the requirements of GDPR, which authorizes us to process your personal data. We always process personal data only to the extent necessary for a specific purpose, which may be:

2.1 Processing to comply with our legal and contractual obligations

If you are interested in our services, it is necessary to provide us with your personal data. Without providing and processing personal data for these purposes, we would not be able to provide you with our services at all. We do not need your consent to process personal data for these purposes, nor can we comply with your request for deletion.

These are in particular the following specific purposes of processing:

  • processes related to your identification and contacting for the purpose of concluding and performing contracts (e.g. registration for property viewings, real estate advice on the selection of real estate, conclusion of a purchase contract);
  • entering into a purchase agreement or other contract related to real estate services provided by the Company;
  • performance of a contract concluded with the Company and keeping records;
  • customer care to deal with customer requests/suggestions/complaints;
  • complying with our statutory accounting and tax obligations;
  • fulfilling our obligations in the area of criminal law, including, for example, those relating to measures against money laundering and terrorist financing.

For these partial purposes, we process personal data only to the extent necessary for the fulfilment of specific obligations and for the period stipulated by legal regulations or necessary for the fulfilment of the relevant contractual obligation.

2.2 Processing to protect our legitimate interests

We also process personal data if it is necessary to protect our legitimate interests. Before starting the processing, we always carefully consider whether our legitimate interest outweighs your rights and freedoms. We do not need your consent for this processing, but you have the option to contact us at any time and object to the processing of your personal data.

These are in particular the following specific purposes of processing:

  • direct marketing, i.e. sending information (marketing communications) to our existing customers in connection with the offer of our services;
  • transfer of your personal data for internal administrative purposes within our FIDUROCK Group;
  • collection of basic network identifiers of website visitors for the purpose of technical administration of our website and diagnosis of technical malfunctions of the website;
  • enforcement of our legitimate claims against our debtors and all related legal and other acts;
  • in justified cases, the provision of evidence in case it is necessary to defend our claims.

2.3 Processing carried out with your consent

We can only process some of your personal data with your consent. The processing of this data helps us to provide you with a better service, but we will not do it without your consent. You can revoke this consent at any time – for example, by sending a letter to our registered office or by e-mail to gdpr@fidurock.com.

With your consent, we process data in particular for the following purposes:

  • data obtained through marketing activities: e-mail marketing communications sent on the basis of the explicit consent of the customers;
  • processing cookies from our website – if you have cookies enabled in your web browser and you agree to their use on our website.

3 How long do we process your personal data?

We always process your personal data only for the necessary period of time, i.e.:

  • if we provide services to you, then we process your basic personal, identification, contact data, service data and data from your communication with us in the customer database for the entire duration of the contractual relationship and also for the period of expiry of the limitation period, i.e. usually for a period of 3 years + 1 year from the date of termination of the relevant legal relationship, i.e. 4 years from the termination of such legal relationship;
  • if you have negotiated with us about concluding a contract, but in the end it has not been concluded, then we process your personal data for additional 3 years from the end of negotiations with you;
  • personal data that we process on the basis of your consent (especially for marketing purposes) are stored for a period of 3 years or until such consent is withdrawn;
  • we process your personal data relating to your unfulfilled claims, if any, until our legitimate claim expires or becomes time-barred;
  • the Company is obliged to process and store personal data that are necessary for the proper provision of services, or for the fulfilment of all obligations, whether these obligations arise from the contract between the Company and you as customer or from generally binding legal regulations;
  • we process your identification data from your identity card in accordance with Article 16 of Act No. 253/2008 Coll., on Certain Measures against the Legitimization of the Proceeds of Crime and the Financing of Terrorism, as amended, for a period of 10 years from the date of termination of the business relationship with you.

4 To whom we transfer your personal data

When fulfilling our contractual and legal obligations, protecting our legitimate interests and other activities related to the processing of your data, we regularly use the professional services of other parties – our suppliers.

These third parties are mainly in the position of processors of your personal data, exceptionally we are joint controllers. Depending on the circumstances, persons from the following categories of processors may participate in the processing of your data:

  • subsidiaries and otherwise affiliated companies with the company and the parent group FIDUROCK;
  • providers of legal, real estate and other services;
  • state supervisory authorities;
  • independent external consultants bound by confidentiality;
  • providers of real estate software and interconnected services, e.g. Realpad;
  • marketing and analytical companies, e.g. for sending marketing communications;
  • suppliers providing us with accounting and tax services;
  • suppliers and administrators of IT systems and IT services.

We transfer your personal data to these processors for the above purposes to the extent necessary. Processors are not authorized to use personal data for their own purposes or contrary to our instructions.

5 How your personal data is secured

The Company is obliged to implement technical and organizational measures to prevent unauthorized or accidental access to the data, their alteration, destruction, or loss, unauthorized transfers, other unauthorized processing, or other misuse.

6 Where did we get your personal data from?

Most of the personal data we process comes directly from you – i.e. from personal data subjects within the meaning of the GDPR.

In some cases, we also obtain your personal data for the purposes of processing from publicly available sources or verify them in these sources, in particular the following public sources:

  • public registers and collections of documents;
  • Insolvency Register;
  • Trade Licensing Register;
  • Cadastre of Real Estate;
  • Records and list of deeds on the matrimonial property regime and the register of pledges;
  • Central Register of Executions;
  • Register of VAT payers.

7 Special procedures for processing your personal data

When processing your data, there is no automated decision-making, profiling or the use of other unusual technology.

8 Cookies

This website uses cookies to improve your user experience, analyze website traffic and personalize content and ads.

We use four types of cookies:

  • necessary cookies, which are necessary for the proper functioning of the website and cannot be turned off;
  • functional cookies, which allow you to provide enhanced functionality and personalization based on your preferences;

9.1 Right of access to your personal data

According to Article 15 GDPR, you have the right to access personal data, i.e. the right to:

  • obtain confirmation from us as to whether we process your personal data;
  • obtain information from us about the purposes of the processing, categories of personal data, recipients, planned storage period, and more;
  • obtain one copy of your personal data from us free of charge.

9.2 Right to rectification of inaccurate or incomplete data

According to Article 16 GDPR, you have the right to have inaccurate personal data rectified and to have incomplete personal data processed about you completed.

9.3 Right to erasure (right to be forgotten)

According to Article 17 GDPR, you have the right to ask us to delete your personal data.

9.4 Right to restriction of processing

According to Article 18 GDPR, you have the right to obtain from us restriction of the processing of your personal data.

9.5 Right to information about recipients of personal data

In accordance with Article 19 GDPR, we are obliged to notify all recipients of your personal data in the event of correction, deletion or restriction of processing.

9.6 Right to personal data portability

In accordance with Article 20 GDPR, you have the right to request from us personal data in a structured, commonly used and machine-readable format.

9.7 Right to object to the processing of personal data

According to Article 21 GDPR, you have the right to object to the processing of your personal data that is carried out on the basis of our legitimate interest.

9.8 Right not to be subject to a decision based solely on automated processing

According to Article 22 of the GDPR, you have the right not to be subject to any decision based solely on automated processing.

9.9 Right to file a complaint with the Office for Personal Data Protection

If you believe that the processing of your data by us has violated the GDPR, you have the right to file a complaint with the Office for Personal Data Protection.

9.10 The right to withdraw your consent to the processing of personal data at any time

You have the right to withdraw your consent at any time if the processing of personal data is based on it.
